Definitions

Callan Online: Callan Online Ltd, a company registered in the UK with registered offices at 705 The Chandlery, 50 Westminster Bridge Road, London SE1 7QY, UK. Our VAT number is GB 244811024

The Website: the website and other online assets hosted at www.callanonline.com.

The Platform: the systems that are accessed through the Website and which enable online English language lessons to be offered by Tutors and purchased by Students including display of Lesson availability, booking and payment processes and tracking of progress and performance.

User: anyone who uses the Website or the Platform

Student: anyone who registers as a Student for the purpose of purchasing and receiving Lessons

Tutor: anyone who applies and is accepted by Callan Online as an independent provider of Lessons

Lesson: a pre-arranged time period, paid for by the Student, during which a Tutor teaches the English language to one or more Students

General

Diese Vereinbarung wird zwischen Callan Online und allen Nutzern geschlossen.
Alle in dieser Vereinbarung enthaltenen Bestimmungen und Bedingungen gelten für alle Verkäufe und Vereinbarungen zwischen Callan Online und den Nutzern sowie für die Nutzung der Website und der Plattform durch die Nutzer.
Durch die Nutzung der Website oder der Plattform als Nutzer erklären Sie sich mit allen Bestimmungen dieser Vereinbarung einverstanden.
Die Nutzungsvereinbarung stellt eine rechtsverbindliche Vereinbarung zwischen Ihnen und Callan Online dar.

Service

Callan Online provides a platform where Users can purchase language lessons and related products, 24 hours a day, 7 days a week. Der Zugriff auf die Plattform erfolgt online über die Website www.callanonline.com.
Um sich als Student bei Callan Online anzumelden, müssen Sie das Anmeldeformular auf der Callan Online Website ausfüllen.
Sie müssen einen Benutzernamen/E-Mail, ein Passwort und eine Skype-ID wählen, um die Anmeldung abzuschließen. You will be held responsible for all actions committed with the use of your username and password and must therefore take all measures necessary to protect these details. You will not access the Callan Online website by any means other than through the User Interface that is provided by Callan Online.
By using the Website, whether or not you register as a Student, you acknowledge that Callan Online owns the copyright to all material published on the Callan Online website and ancilliary materials. Callan Online may provide contact details of their Tutors to you with the sole purpose of facilitating communication about and during lessons. You will not use this information for any other purposes, and will not share this information with third parties.
Callan Online may terminate or suspend your access to all or part of the website, without notice, for any conduct that Callan Online, in its sole discretion, believes is in violation of any applicable law or is harmful to the interests of another user, a third party or Callan Online.
Despite any other established legal rights, Callan Online is entitled, at its own choice, in case of ‚force majeure., to cancel a lesson booking, or cancel this User Agreement without legal intervention, by informing you in writing. You are not entitled to any damages, unless, given the circumstances, such cancellation would be unacceptable according to measures of reason and fairness.
All communication between Callan Online and you will be electronic; through email or notices posted on the Website. Callan Online reserves the right to record lessons for purposes of teaching quality control.

Prices, Payment and Delivery

Prices will be at the levels and in the currencies as published from time to time on the Callan Online website. Payment methods will be as described on the website. Cancellations and refunds

Es werden alle Anstrengungen unternommen, die gebuchten Lektionen zu erteilen, und Callan Online wird sich nach besten Kräften bemühen, Ersatzlehrer zu finden.
Wenn Callan Online eine bezahlte Lektion nicht erteilen kann, können Sie innerhalb von 14 Tagen nach der Stornierung entweder eine Ersatzlektion oder eine vollständige Rückerstattung wählen. Die Haftung von Callan Online beschränkt sich auf die anteilige Rückerstattung des Preises der nicht gelieferten Lektionen.
Ihr Widerrufsrecht – Nachdem Sie Lektionen gekauft und bezahlt haben, haben Sie das Recht, innerhalb von 7 Werktagen nach dem Zahlungsdatum zu stornieren und eine vollständige Rückerstattung zu erhalten, es sei denn, Sie haben eine Lektion zu einem zufriedenstellenden Standard gebucht und erhalten.
Sie müssen Callan Online schriftlich per E-Mail über Ihre Absicht informieren und alle weiteren Stornierungsanweisungen befolgen, die von Callan Online festgelegt wurden. Callan Online will then reimburse you within 14 days. This guarantee does not apply if the Lesson has been provided.

Liability

Callan Online haftet nicht für Schäden jeglicher Art, die sich aus der Nutzung der Website oder der Plattform ergeben.

Callan Online bemüht sich nach besten Kräften, sicherzustellen, dass die Website und die Plattform jederzeit voll funktionsfähig sind. Due to the nature of the internet, Callan Online cannot guarantee that the Website and the Platform will be free from delays, interruptions or errors. Callan Online will take all reasonable efforts to ensure that information on the Website is correct, but cannot give representations or warranties, express or implied, in relation to the accuracy or completeness of the said information.
Callan Online takes precautions to protect personal data collected through the website, but in the event that Callan Online’s system is infiltrated by unauthorized third parties, Callan Online will not be liable for any resulting misuse of personal data.
Any of Callan Online’s liability resulting from use or visitation of the website will be limited to direct damages and an amount up to the price paid for Lessons during the 3 month period prior to any claim. Die Haftung für indirekte Schäden ist unter allen Umständen ausgeschlossen.

Applicable Law and Jurisdiction

This User Agreement is governed by the laws of England and Wales and the parties submit to the jurisdiction of the courts of England and Wales, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980. In the case of translation or explanation of the contents of Callan Online’s website, the English version of the text in the website and these General Terms and Conditions will remain determinate.
