Definitions

Callan Online: Callan Online Ltd, a company registered in the UK with registered offices at 705 The Chandlery, 50 Westminster Bridge Road, London SE1 7QY, UK. Our VAT number is GB 244811024

The Website: the website and other online assets hosted at www.callanonline.com.

The Platform: the systems that are accessed through the Website and which enable online English language lessons to be offered by Tutors and purchased by Students including display of Lesson availability, booking and payment processes and tracking of progress and performance.

User: anyone who uses the Website or the Platform

Student: anyone who registers as a Student for the purpose of purchasing and receiving Lessons

Tutor: anyone who applies and is accepted by Callan Online as an independent provider of Lessons

Lesson: a pre-arranged time period, paid for by the Student, during which a Tutor teaches the English language to one or more Students

General

Настоящее Соглашение заключается между Callan Online и всеми Пользователями.
Все положения и условия, содержащиеся в настоящем Соглашении, применяются ко всем продажам и соглашениям между Callan Online и Пользователями, а также к любому использованию Пользователями Веб-сайта и Платформы.

Service

Callan Online provides a platform where Users can purchase language lessons and related products, 24 hours a day, 7 days a week. Доступ к платформе осуществляется через сайт www.callanonline.com.
Чтобы зарегистрироваться в качестве студента в Callan Online, Вам необходимо заполнить форму заявки на сайте Callan Online.
Для заполнения заявки Вам необходимо выбрать имя пользователя/электронную почту, пароль и Skype ID. You will be held responsible for all actions committed with the use of your username and password and must therefore take all measures necessary to protect these details. Вы не должны разрешать никому другому входить на сайт Callan Online, используя Ваше имя пользователя и пароль.
Услуги Callan Online не доступны для несовершеннолетних в возрасте до 18 лет без явного предварительного согласия их родителей или опекунов. Регистрация студента Callan Online является персональной и не подлежит передаче.

You will use the website only for lawful purposes and you are prohibited from posting on or transmitting through the Callan Online website any material that Callan Online in its sole discretion judges to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, discriminatory, profane, hateful, fraudulent, racially, ethnically or otherwise objectionable.
You will not access the Callan Online website by any means other than through the User Interface that is provided by Callan Online.
By using the Website, whether or not you register as a Student, you acknowledge that Callan Online owns the copyright to all material published on the Callan Online website and ancilliary materials. Callan Online may provide contact details of their Tutors to you with the sole purpose of facilitating communication about and during lessons. You will not use this information for any other purposes, and will not share this information with third parties.
Callan Online may terminate or suspend your access to all or part of the website, without notice, for any conduct that Callan Online, in its sole discretion, believes is in violation of any applicable law or is harmful to the interests of another user, a third party or Callan Online.
Despite any other established legal rights, Callan Online is entitled, at its own choice, in case of ‘force majeure., to cancel a lesson booking, or cancel this User Agreement without legal intervention, by informing you in writing. You are not entitled to any damages, unless, given the circumstances, such cancellation would be unacceptable according to measures of reason and fairness.
All communication between Callan Online and you will be electronic; through email or notices posted on the Website. Callan Online reserves the right to record lessons for purposes of teaching quality control.

Prices, Payment and Delivery

Prices will be at the levels and in the currencies as published from time to time on the Callan Online website. Payment methods will be as described on the website. Cancellations and refunds

Будут приложены все усилия, чтобы предоставить забронированные Уроки, и при необходимости Callan Online приложит все усилия, чтобы найти замену Репетиторам.
Если Callan Online не может предоставить оплаченный Урок, Вы можете выбрать либо замену Урока, либо полный возврат денег в течение 14 дней после отмены. Ответственность Callan Online ограничивается возмещением стоимости Уроков, которые не были предоставлены, на пропорциональной основе.
Ваше право на отмену — После того, как Вы приобрели и оплатили Уроки, Вы имеете право в течение 7 рабочих дней после даты оплаты отменить их и получить полное возмещение, если Вы не забронировали и не получили Урок удовлетворительного качества.
Вы должны сообщить Callan Online в письменной форме по электронной почте о своем намерении и должны следовать всем дальнейшим инструкциям по отмене, предусмотренным Callan Online. Callan Online will then reimburse you within 14 days. This guarantee does not apply if the Lesson has been provided.

Liability

Callan Online не несет ответственности за любой ущерб любого рода, возникший в результате использования Веб-сайта или Платформы.

Due to the nature of the internet, Callan Online cannot guarantee that the Website and the Platform will be free from delays, interruptions or errors. Callan Online will take all reasonable efforts to ensure that information on the Website is correct, but cannot give representations or warranties, express or implied, in relation to the accuracy or completeness of the said information.
Callan Online takes precautions to protect personal data collected through the website, but in the event that Callan Online’s system is infiltrated by unauthorized third parties, Callan Online will not be liable for any resulting misuse of personal data.
Any of Callan Online’s liability resulting from use or visitation of the website will be limited to direct damages and an amount up to the price paid for Lessons during the 3 month period prior to any claim. Ответственность за косвенный ущерб при любых обстоятельствах исключается.

In the case of queries or complaints concerning any Callan Online services, Tutors, products or procedures, please email (support@callanonline.com). You will receive a reply within three working days.

Applicable Law and Jurisdiction

This User Agreement is governed by the laws of England and Wales and the parties submit to the jurisdiction of the courts of England and Wales, with the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980. In the case of translation or explanation of the contents of Callan Online’s website, the English version of the text in the website and these General Terms and Conditions will remain determinate.
